Zusammenfassung
Der Titel dieses Buches — „Theorien der europäischen Integration“ — lässt darauf schließen, dass der Leser es mit Integrationstheorien zu tun hat. Dieses Kapitel aber behandelt keine Integrationstheorie. „Integration durch Recht“ („Integration Through Law“ — ITL) zeichnet sich durch Fragmentierung und Heterogenität aus, besitzt kaum gemeinsame oder gar homogene Annahmen, Erwartungen, Reichweiten, Methoden oder Erkenntnisgegenstände und verfügt nicht über eine konsistente Methodologie oder ein kohärentes Verständnis von Prozessen oder Gegenständen. ITL besitzt eine theoretische Reichweite, welche sowohl das kleine Detail als auch die große Erzählung umfasst, und ist daher weniger eine Theorie als eine Bewegung: eine organisierte und konzertierte Anstrengung von Wissenschaftlern, die ein gemeinsames Ziel im Auge haben. Das einigende Erkenntnisinteresse von ITL ist die Untersuchung der Rolle des Rechts und der Rechtsinstitutionen im Prozess der europäischen Integration. Dieses gemeinsame Ziel erlaubt es immerhin, ITL wie eine Theorie zu behandeln.
