Adjustment for EU–Mercosur, Continuity for the Rest: Explaining the Evolution of UIA’s Preferences (2016–2020)

Abstract

This chapter focuses on a period when the government actively sought the formation of north–south PTAs (2016–2019)—although it also covers the first months of 2020, when a new government reversed this policy. The chapter digs deep into the processes that led to a parallel continuation of UIA’s overall rather opposing preference and the adjustment to de facto neutrality on EU–Mercosur. With this aim, it characterizes the government’s push for a north–south PTA negotiation agenda and the reactions it caused among the industry. Then, it traces how government-sectors interactions on EU–Mercosur led to internal divergences within UIA regarding this specific agreement. The chapter concludes by assessing the explanatory capacity of the competing causal mechanisms outlined in Chapter 2 in light of the CPOs collected.

    According to a newspaper article, the management of non-automatic licenses was the object of a dispute within the Production Ministry, as the Foreign Trade Secretariat defended a more liberal regime and the Industry Secretariat, led by Etchegoyen, a more restrictive one (La Nación 2016).

    In contrast, several interviewees mentioned that UIA’s arguments used to find greater reception at the government’s Industry Secretariat. Which, although was not frontally opposed to a EU–Mercosur PTA, “it always represented the protectionist stance within the government (…), of conceding the minimum,” given its concern for the impact on the industry (interviews, two foreign trade officials). Since this Secretariat was led by actors coming from UIA’s technical structure, this evidence provides an additional indication of its predominant view on these deals.

    The sector comprises 12 terminals whose capital of origin is either from the EU, the US, or Japan. Unlike Brazil, their production does not cover the bulk of the domestic market. So, for firms, PTAs with the countries of their parent companies (but not with those of their competitors) represent an opportunity to import some segments. That said, ADEFA acknowledges that a rapid trade opening with developed economies would mean disappearance of the sector in Mercosur, due to the likely relocation of FDI. And as the first PTA with these potential partners sets the parameters for the rest, firms within ADEFA have agreed to request the same liberalization schedules for the EU, the US, and Japan. However, with one exception (Toyota), regional CEOs in Brazil are placed above local CEOs in Argentina, so the former’s defensive concerns end up prevailing in the sectoral stance within Mercosur (interviews, two sectoral staff and three foreign trade officials).

    As explained in Chapter 5, automobiles are excepted from Mercosur’s free trade area, being regulated instead by bilateral deals among members.

    According to Página 12 (2017), AFAC perceived a risk of relocation of horizontal FDI: “We are very concerned about the impact on investments. The calculation of a multinational terminal or auto parts firm when deciding on an investment includes the situation of tariffs. If they are removed, the investment here becomes less profitable, which implies that the free trade policy makes some investments in the sector unviable. The baskets are long, there is talk of ten years. But this can have an immediate impact on investments.”

    On the issue of public procurement, Argentina also agreed to establish an optional accession clause, with reciprocity, for subnational entities (provinces). However, negotiators expect that most provinces will not adhere, so their procurement will continue privileging domestic producers (interview, diplomat).

    Regarding Argentina’s accession to the PCT, another EU demand on IP, a non-binding, best endeavor clause was finally agreed.

    Notably, according to officials involved in the negotiation, in addition to the trade-off for the opening of Mercosur’s maritime services described in Chapter 5, CILFA’s transnational networks of influence through NGOs in Europe was also instrumental for this outcome (interviews, two foreign trade officials).

    In line with this, a newspaper reported that “behind doors,” within the organization, there were differing views between those critical of the agreement and those neutral (Perfil 2019).
